As for a lot of people will leave Datek if they cannot short some small companies' stocks, I think that is exactly other people who decide to stay in Datek need. The reason for this is that Datek system is now overloaded because they have too many customers. So somebody's loss will always be somebody else gain.

What about being able to short instantly, without waiting for someone to confirm they have the shares? I'd venture that no other brokerage begins to match the shorting versatility of Datek in either speed or availability of shares, the recent buy ins not withstanding. Selling short is one arena where Datek beats every other broker hands down. I've recently opened a Brown & Co account, and I'm happy with them. But when I want to short, I go with Datek.
