Dear Dave: I am a retired CPA who specialized in SEC work and was involved in a number of IPO's over my lifetime. I worked with many securities attorneys. I agree with you completely that if this is LEGAL advice it is horribly deficient. Even perhaps so much as malpractice. I would hope that such silence DOES NOT denote that the client is holding back a big negative. THAT would for SURE be malpractice. Especially while the stock is so depressed NOW is the time to get any remaining skeletons out of the closet if there are any. I have to believe this is NOT legal advice as it is beyond my comprehension any securities attorney could be this stupid. Rather, I think it is an ego thing. I think the founder is VERY UPSET with his underwriters abandoning him (for what I am sure he believes is a better business plan) and his new shareholders suing him ( he likely doesnt understand the nature of these class action attorneys who sue anyone whos stock drops for any reason). I suppose his attitude is I WILL SHOW THEM. And the rest of us will just have to wait till he shows us. JDN
