Craig, I don't think it's likely.

Has anyone noticed that Amazon has _yet_ to issue a formal response to Walmart's lawsuit? I watch biz headlines all the time, and within 24 hours or so there is always a quick denial from the company being sued, along with the usual "blah blah blah, they don't have a case"

But Amazon has said nothing. No rebuttal, no public statement claiming that they were innocent. I think this means Amazon knew it got caught, and they're trying to settle behind the scenes as we speak. Amazon simply cannot afford a drawn out legal battle with WalMart- someone jokingly said that Amazon's revenue is nothing more than a rounding error for WalMart. :)

I think the suit was a shot across the bow of Amazon. Walmart could very easily have waited a few weeks and then got a 30 day temporary injunction against Amazon's use of any disputed ordering systems. Can you imagine what this would do to Amazon's revenue during the holiday season?

I've got to admit, I nearly forgot about the walmart suit myself. For the above reason- there was no amazon response for me to read about in the newswires!
