Clark: I am going to "bite" on this one. A couple of questions, first what was the filing date on the patent? Next, issue date? Last, what was the date of commercialization of CDMA? Although look back it might be obvious now, it might not have been obvious. Remember, to formulate a 35 USC 103(a) rejection, the invention was have been obvious to one with ordinary skill in the art at the time the invention was made I will leave the technical up to you, since I don't know the answers to those questions.
