Fair question. However I don't expect that Qualcomm would enter into an important contract without proper corporate resolutions establishing the authority of the signer. I also don't expect them to fax out executed copies of the contract which are probably sitting in some well secured vault.

FOR ANYONE WHO MISSED VALUEMAN'S POST ON THURSDAY NIGHT HERE IT IS AGAIN:

Qualcomm has faxed a release out tonight that is a copy of a
12/1/1989 Non-disclosure agreement with Ericsson. I have not
seen it anywhere online. It is long, but they direct you to a single
paragraph that is most relevant:

5. Ericsson Radio Systems hereby agrees and acknowledges that
Q's specific implementation of CDMA technology and Spread
Spectrum techniques in conjunction with any telephone or cellular
radio telephone or mobile radio product or service("Qualcomm's
CDMA Technology") is proprietary to QCOM. ERS hereby agrees
that Q's CDMA Technology includes, but is not limited to, Q's
techniques for soft handoff, interference control, voice activity
detection, power control, multiple receivers for multipath
mitigration and CDMA signal design including forward error
correction, PN sequence generation, pilot carrier and CDMA
synchronization. Further, in addition to Q's CDMA Technology, the
implementation of such a system, including, but not limited to,
interface information, shall remain Q's Confidential and
Proprietary information and ERS shall not use this information in
any other manner than permitted by this agreement.
