re. the two points from Price and Value

I was looking into that 90 day period until the Final Determination becomes effective. I discovered that the Assistant Secretary's decision is the final word from the Interior Department. All parties already had a chance to raise questions or make comments before the decision was made. The Final Determination represents the outcome of years of review and study. The DOI and the BIA have determined that the Band does exist as a Tribe according to all their criteria. It is extremely unlikely that any request for reconsideration would be made, or that it could have any impact on the Assistant Secretary's decision. All the technical points have already been studied in great detail.

One important element of the this 90 day period is that the Band has this time to provide a location for their homeland. This means that the land has to be located, negotiated and paid for in the very near future. The location is the Band's decision, but I believe they are consulting with the company. So far as I know, the Band and the company have been very secretive about the actual location. One would think they probably have a pretty good idea of where it will be by now. It seems to me that in the past there has been a of misleading information about the location. Naturally, neither the Band nor the company want to deal with the hassles that could result from disclosing the location before the deal for the land is finalized.

Some people have also raised questions about the second paragraph of the last press release. I've asked some questions about it, and my understanding, for what it's worth, is that the Company and the Band have had an agreement which specifies an ongoing legal relationship in the future. One of the purposes of the existing agreement was to define the nature of the relationship up until federal recognition is achieved. That agreement also specified that once federal recognition was achieved, further elements of the ongoing relationship would be specified and legally concluded. The process is a natural evolution, and it shows that a milestone has been reached. I'm not sure whether the contract they are preparing now also includes an agreement with an operator or financier.
