NEW YORK (Dow Jones)--Visx Inc. (VISX) lost a U.K. laser patent infringement case it brought against Nidek Technologies Inc. of Japan.

In a press release Monday, Nidek said it defeated Visx Inc.'s (VISX) attempts to enforce two of Visx's principal patents against Nidek's EC-5000 excimer laser system in the U.K.

Nidek said a U.K. Patents Court judge found its EC-5000 excimer laser did not infringe Visx's U.K. European patent for scanning beam technology, and that Visx's U.K. European patent for masking technology was invalid.

Nidek also said Visx was required by the judge to pay a "significant" proportion of Nidek's legal costs.

In a separate news release Oct. 19, Visx said it will continue to enforce its patents against Nidek in the infringement actions pending in Canada and France.

Nidek Co., a privately held company located in Japan, makes intraocular lenses and surgical and diagnostic instrumentation for eyecare specialists.

Visx Inc., Santa Clara, Calif., researches and develops refractive laser technology.

Why would you own a stock that has the risk of an extraordinary loss of key patents?
