For the record, I am skeptical of anyone stating that they have a "blocking" patent. I am an extremely firm believer in there is more than one way from point A to point B, the simplest being a straight line.

Furthermore, even if we assume that Ericsson, or Qualcomm, has blocking patent(s), it doesn't mean that their competition can't receive a patent. The competition could receive a patent on an improvement, however that competitor would have to sign a licensing agreement with the blocking patent holder.

Does that make sense?
