Admission of guilt

10. On behalf of the two Thermo Tech Defendants, I unconditionally apologize to Mr. Justice Cohen, the Court and to both Plaintiffs for failing to comply with the Orders issued by Mr. Justice Cohen on January 20th and July 10th, 1998. I assure the Court that the Thermo Tech Defendants will make full and frank disclosure of all relevant documents in this lawsuit and will fully comply, without delay, with further Orders that may be granted in this litigation.

Thermo Tech has no statement of defense going into the final phase of the contempt hearings. They are apoligizing to the court ant Trooper. They readily admit failure to comply with the court order Jan 20 1998 and Jul 10 1998. When the next phase of litigation proceeds they have no defense on why they did not turn over the required documents.

The next phase will not be if Trooper will receive damages but how much. Thermo has been proven in breach of contract and will pay dearly for this. Rene's actions in this case will have a profound effect on Thermo's future viability. As long as there is a damage suit with Trooper I do not see how any financing can be obtained until this is settled. Thermo is on the brink of financial ruin the TPP lawsuit could push it over the edge.

I find it ironic that the company that Rene said would DIE ON THE VINE may be Thermo's undoing. I believe Trooper would be willing to make a fair settlement to end this however the ball is in TTRIF'S park.

Rene's action during this litigation has not been in the Thermo Tech shareholders best interest in my opinion.

Good luck to the dissident group if elected I hope you have success in settling this serious matter so both companys can move on.
