Actually I have -- and you are getting a little shrill.

It all starts with the underlying truth of the subject matter, i.e., whether or not AZNT is a PoS, perhaps even a criminal PoS to boot.

I think any rational observer would agree that the former certainly is true, the latter may be true but its not for me to decide.

If you own it, hyping a stock is similar to a sales contract on a home. (It is not even necessary to discuss if one is getting compensation - that was made clear yesterday by the SEC). If you know you have a leaky basement, and don't disclose it, a contract for sale can be rescinded due to failure to disclose a material fact. The party failing to disclose may also be liable for damages. If the dollar amounts are large enough, fraud statutes may come into play.

The points in my link and my post highlight many material FACTS. In my opinion, and I believe it would be the opinion of practically any fair-minded and rational observer, an attempt to deflect consideration of material facts, or to minimize them, constitutes an attempt to mislead -- a violation of Section 10b.

To be clear, if one doesn't own a particular stock nor is one receiving any compensation from any source, one can "bash" all they want only subject to the risk of libeling the "bashee." However, if one does own a particular stock or is receiving compensation from any source, federal law comes into play. The "hypester" has a higher legal responsibility. Hypesters don't like that.
