I am not so sure whether CREAF's purchase really is inside trading. Were they not parties to the deal? If someone who was not a party to the deal overheard them, that person would be guilty of inside trading were he to act on such knowledge. Their characterization of their purchase as a good investment could have been interpreted by the market as having knowledge of 3dfx's good position, akin to insider knowledge.
