I haven't ever heard of a criminal avoiding conviction by using the "other people do it, too" defense. Why should it work here? JMHO, of course.

At the time the deal was being negotiated, however, America Online was four times as large as its nearest competitor, and Netscape had an estimated 84 percent of the browser market Monopoly power refers to power. Market share is just one indication of it. America Online never had and still doesn't have any power over what online service people use. Netscape had a certain amount of power over what browser people use because businesses like to standardize. But Microsoft has tremendous control over what operating system people use.
