After repeating the arguments over and over ad nauseum and admitting that phone to phone IP telephony is really not an enhanced service, the argument to continue the exclusion from the requirements of section 254(d) is simply "we believe that we are being faithful to the balance struck by Congress." In other words, you prove that Congress had a different intent. How do you do this? You get Congress to pass a law clarifying intent. What's the political chance of this happening? Somewhere between little and none. It's really very simple.
