Can AOL even provide highbandwidth service without ATHM's architecture . I would like so opinions.

1. Is true but irrelevant. The FCC concern is that ATT would have an under regulated monopoly in broadband.

2. The FCC is concerned that ATT will abuse power.

3. It isn't ATHM that the FCC is concerned about. It is T-TCI. I sure hope the FCC blocks the merger.

4. He's right. They have their own socialistic agenda that comes right out of populist, consumer, all power to the peoples America. They have a self-righteous duty to protect the poor. I'll take pols any day over them.

5. I've argued endlessly about ROW and stringing your own Pure, non-HFC, fiber. T is looking for a way to get by cheap. Even if they rolled their own, the FCC would preempt the privacy under eminent domain.

6. It isn't just AOL. TCI's fiber network would have to be made available to all ISPs and telcos local and long. AOL doesn't need to cut any deal. They can let the FCC do all the cutting. It would be a wise move, but big ugly companies are never wise, especially when their monopoly is government guaranteed.

AOL has 12 million subscribers. That is clout. That is a constituency. That is financial power which could erect a good co-location in TCI's and ATHM's face before the FCC made a final decree.

The leasing status is unclear. The lease payments go to TCI to maintain the fiber network and AOL could claim that the extra traffic is of sufficient benefit to TCI that TCI should get only nominal compensation. Not one dime goes to ATHM.

Posturing to get the best deal from whom?
