Robert_Pool (38/M/AB, Canada) Nov 2 1998 7:51PM EST <In an enterprising legal move in the heated proxy battle for control of Thermo Tech Technologies, Thermo Tech and Rene Branconnier, its besieged chief executive, have filed a defamation suit against dissident shareholders, seeking a permanent injunction on further publication of the dissidents' filed Thursday in the Supreme Court of British Columbia, circular and related materials.> My Lawyer pointed out that Thermo Tech has implicated me as being not only a "SHAREHOLDER" but a "DISSIDENT SHAREHOLDER". Both are in FACT NOT TRUE! I am not a shareholder at all and have not been for some time before I heard about the dissident movement. <In an endorsed writ of summons Thermo Tech lawyer Michael Skene of Ladner Downs targets David Pickering, Dr. John Pickering, John Holley, Dr. Gary Baggs, John Primrose, ROBERT POOL, Jay Taylor, two John Does and three Jane Does. Thermo Tech and Mr. Branconnier each seeks general, special, aggravated and punitive damages for allegedly defamatory statements. Mr. Skene claims the defendants published the offending statements in a September "manifesto," the Oct. 19 dissident proxy circular, an Oct. 23 newsletter and postings to an Internet discussion board and website.> Here my Lawyer pointed out "Mr. Skene claims the defendants (which I am one) published the offending statements in a September "manifesto," which it is suggested contains the "defamatory statements" . WHICH AGAIN IS TOTALLY UNTRUE! I never participated in this manifesto what so ever at any time. I didn't even know of it's content until posted on the Yahoo thread. <The writ claims the defendants conspired to cause injury and harm to Thermo Tech and Mr. Branconnier.> CONSPIRED??? What a ridiculous claim. HOW AND WHEN MR. Branconnier? I personally have had very limited contact with those party's related to Thermo Tech with exception through the dialog on the YAHOO and SI message threads. <"Mr. Skene alleges the defendants agreed to "carry out unlawful conduct directed towards one or both of the plaintiffs," although he provides no details."> Now these two points, MR. Branconnier, I personally take offense. <The suit seeks a interim and permanent injunctions to restrain further publication of the dissidents' documents and the allegedly defamatory and "malicious falsehoods" they contain, or similar statements.> Now Mr. Branconnier, it is YOU who has IN FACT made a statement that is "malicious" and contains "falsehoods". I expect in VERY SHORT ORDER a FULL retraction and public apology. If not, I will be in contact with Mr. David Lunny on a much less casual basis and request that he be my legal council.
