the uptick rule does not apply to market making activities; it's impossible to prove--to or by the SEC that a MM is illegally shorting---wanna go out and prove up a shorters "conspiracy" in a stock that's up 165% in a coupla weeks?? Trust me, it aint possible, and there is no--repeat no--evidence of any unlawful activity. Shorts are permitted to beat up an a stock and get blown out--eg, when an LU deal comes along--just as longs are permitted to jump on a stock and do well when LU comes along. that's life in an active market; see Steve's [ost over at yahoo, BTW.
