Nice thought but Datek revised their customer agreement a few months or so ago and I'm willing to but that somewhere in the finest of print is a statement to the effect: ~We Datek Securities are NOT responsible for our silly slow servers and total incompetence. And by signing agreement you hereby agree not to hold Datek responsible for anything under the sun, moon, mars, jupiter....~

Class action lawsuit will only do lawyers good. As a regular customer, you are lucky if you can recover $50, believe it or not. The only thing comes out of it, it will make you feel even or revenged.
