Well, let me ask you the following questions :

Do you think it is a crime if a rich man said
1) he will try to be richer ?
2) He will try to be richer by working harder to earn more money ?
3) He will try to be richer by robbing the bank ?

Do you think it is a crime if NSCP said:

1) We will try to protect our Browsers market ?
2) We will protect our browser market by developing better products ?

Do you think it is a crime if Microsoft said :

1) We will prevent Apple to get into the OS market .
2) We will prevent APPLE to get into the OS market by developing better products?


So far, the what so called evidence only indicated that Microsoft said will protect its
OS market , but it never said by what means . It is not a crime for a company to protect its market. Every company wants to protect its own market , including Apple and NSCP. What define legal or illegal is by what means.

Now show me your evidence.

Dear Beard: If the crime (wounding of NSCP) is bringing NSCP from 90% of browser market to 50% than we will have to devise a new sort of capitalism. I guess NSCP figures if MSFT can have a monopoly why can't NSCP maintain one in the browser market. No one is stopping them except MSFT who made a competitive browser. There was very little penetration on MSFT's part until they got to the better versions. I am sure you yourself can verify that by your own experience. As a Mac owner I am amazed that more of you don't really strike a blow for market place freedom and buy a Mac.

That is, it's probably OK in general to hurt a company, but you can't hurt a company for the purposes of preserving your monopoly.

In your assumption, once a company has a monopoly (or dominate market position or whatever monopoly mean by DOJ), then the only thing this company can do is wait for its competitors to shot at its head and lost the market position. If the company develops any new products or even improves their existing products or markets their products, they would damage the competitors' chance to defeat them. Because they are trying to enhance their already dominated market position, so their purpose is to preserve monopoly. And by your logic, that is illegal.
