Five2Mil,
Why are you concerned about your legal rights and not what is ethical? You didn't pay for the shares, they are not yours, you should let the brokerage house know because it is the right thing to do.

Besides they will figure it out eventually and this way you get to pat yourself on the back for being such a good guy/gal rather than someone that has no moral foundation.

Knowing what you do, and having disclosed it to the world, you are in an indefensible position if you do not immediately correct this mistake. At the least, any attempt, even passively, to conceal what you know is a mistake in your favor approaches conversion -- and you must make no attempt to conceal it. With your disclosure you have warned everyone of your fraudulent intentions -- i.e. that you plan to deprive your broker of ownership of the shares unless he is smart enough to find out about it without your help. You may hope that in time you will be able to convert these shares to your ownership by selling them or having a certificate issued. I warn you specifically against any evasion when they notify you or complaint if they reverse the transaction when they figure it out. CAUTION: This is not legal advice.

Off topic about broker's error:

About thirty years ago we moved and inadvertently left a suitcase full of worthless stock certificates in the cellar of our old house. These were in not registered to us, as was common in those days. The new owners of our house took the certificates to the only broker in town to determine their value. Only after the broker told them the shares were worthless, they called us up and told us that we left them behind. Too bad for them -- their dishonest conduct became widely known in our small town.
