Has Rock actually filed a claim for compensation? Is this part of the public record? Has the BC Govt filed a defense? When do they have to do this by.What precedents are being used by Rock? What's the time line?

Yes On January 9, 1998, Rock Resources commenced a legal action by way of a Writ of Summons in the Supreme Court of British Columbia against the Province of British Columbia for in excess of $15 million as "fair compensation" for the expropriation of the Amber Property, and expects the action to be settled during the 1998 calendar year.

What precedents are being used by Rock?
A statement that is part of public record made by the BC Government in july 1995;

The BC will reach "fair compensation agreements" with ALL properties owners who had land expropriated for parkland. Each case will be treated on an individual basis.

The BC Government have compensated two out of the many! In each case the Government stated they will deal on an "individual basis" dragging out the compensation process so that Clark could get re-elected.

In an effort by the Province of British Columbia to aim new regulations at attracting mining investing... "The province is moving to establish greater security of tenure by compensating individuals whose mineral claims are expropriated for parks."

A formal paper has been drafted and accepted by the BC Government that establishes "security of tenure" for properties, in this document it states that all mineral claims expropriated will be compensated.

The Minister for Mines is on record as stating that his government will settle all "past compensation cases for expropriated mineral properties"! Two weeks after announcing this he allocated a buearacrat to Rocks case, stating he wished the thing settled ASAP!!

Has the BC Govt filed a defense?
Not yet. The BC Government has asked Rock to drop their suit. Rock has informed the BC Gov. that they will,..... assuming suitable compensation prior to the end of 1998

When do they have to do this by. What's the time line?

If they fail to meet an agreement ,Rock will be given a court date for Jan99-Mar99. It is at that time the BC Gov must tender there defence!

Timeline is from now-till Dec15/98. If not sauitably compensated then secure a court date for Jan/Mar99 (Mr. Kennedy has been informed that this will not be difficult)
