It may be a real company but I'd say it's in for some trouble with that release - either NASD sanction (for a misleading press release) OR at minimum a class action from whoever bought in after thursday's PR. Why? Let's look at the press release:biz.yahoo.com Thursday November 12, 9:30 am Eastern Time Company Press Release This is the original one, right? The only one released by the company, on Thursday at 9:30 AM.AvTel Communications Introduces DSLink Services Bringing Affordable High Speed Internet Access to Residences and the SOHO Market in Santa Barbara, California 50 Times Faster Than Conventional Modems? Now That's Fast! SANTA BARBARA, Calif.--(BUSINESS WIRE)--Nov. 12, 1998-- Speeds Up to 50 Times That of a Conventional Modem Are Now an Option for Homes and Small Office/Home Office Environments through ADSL, at a Fraction of the Former Cost Right in the title it says available in Santa Barbara.AvTel Communications, Inc., (Nasdaq:AVCO - news), and its Internet service provider subsidiaries Silicon Beach Communications and WestNet Communications today announced the launch of its DSLink Service, providing high-speed Internet access over Asymmetric Digital Subscriber Line (ADSL). ADSL is a new modem-based technology that provides a dedicated connection to the Internet that is up to 50 times faster than conventional modems. It works on an existing phone line and allows the sending and receiving of voice and data simultaneously. The user is always just a click away from the Net with no waiting and no busy signals. It's relatively new. At least, xDSL and Cable Modems are the latest things available to consumers. Everything in that paragraph is true.DSLink Services will be available to residents and businesses within three miles of one of their local telephone company's Central Offices. Currently it is available in downtown Santa Barbara, with further deployment through Goleta and Carpinteria due by the end of November. Customers will incur additional charges from their local Telephone Company, in addition to their existing line charges, and may select a service offering from Silicon Beach for as little as $30/month. Nothing about a nation-wide rollout here. Everything in this paragraph is true.''Our DSLink Services enable us to provide our Residential and SOHO customers access speeds previously only cost effective for larger businesses,'' stated Dave Clark, General Manager of AvTel's Internet Services Division. ''We've always provided businesses with high speed access and developed the applications that drive their necessity, so I'm extremely excited about bringing these advanced capabilities home.'' Yada yada, but true.Internet users with DSLink Service will have greater access to the new and emerging technologies of the Internet, including full-motion video, faster loading times, streaming content and unbelievably fast download speeds -- all at value-priced rate plans. True. Both Silicon Beach Communications, Inc. and WestNet Communications are Integrated Communications Providers of Internet access, telephony service, calling cards, Web development and Web hosting to individuals and business customers. Silicon Beach and WestNet own and operate Internet points-of-presence throughout the Central Coast of California. True.AvTel Communications, Inc. is a provider of broadband network services integrating voice, data and video networking solutions for individuals and business customers. The Company markets and sells a broad range of telecommunications and advanced network services through independent value-added resellers and internal direct sales professionals. The Company is fully certified by the FCC and registered in all 48 contiguous states and Hawaii. In addition, the company holds billing agreements with all the Regional Bell Operating Companies, GTE and other independent telephone companies. Is this where you're claiming they stated a nation-wide rollout? That's so thin it makes Karen Carpenter look fat.All statements in this press release other than statements of historical fact are forward-looking statements that involve substantial risks and uncertainties. Reference is made to the Company's Annual Report on Form 10-K for the year ended December 31, 1997 and to the Company's other reports filed with the Securities and Exchange Commission for a discussion of such risks and uncertainties and other factors that may have material effect on the Company's business. Boilerplate. A completely true press release. Unfortunately you're right about the class action suit. It'll be filed soon because there are too many vultures willing to accommodate people who made a mistake and are now looking for someone else to blame. How sad that a company can be blamed, sued and probably bankrupted for the greed-caused mistakes of third parties who are now looking for a "do-over".
