AT&T Says Open Internet Access May Threaten TCI Merger (Repeat)

Washington, Nov. 16 (Bloomberg) -- Forcing AT&T Corp. and
Tele-Communications Inc. to give competitors open access to their
high-speed Internet networks could ''severely jeopardize'' the
companies' $46 billion combination, AT&T told federal regulators.
''There is no basis in law or fact for the proposed
conditions, and the imposition of them ... would severely
jeopardize the proposed merger and the immense benefits it could
offer consumers,'' AT&T told the Federal Communications
Commission late Friday.
America Online Inc., the largest U.S. Internet service
provider, is pushing the FCC to require the combined AT&T-TCI to
let Internet service providers have open access to their network
as a condition for approving the transaction.
The FCC is currently reviewing whether the AT&T-TCI merger
would be in the public interest. The Department of Justice is
looking at whether it would violate antitrust laws.
Shares of New York-based AT&T fell 9/16 in recent trading to
60 11/16 and shares of Englewood, Colorado-based TCI fell 1 3/16
to 38 3/8.

Matt,

wake up, this is one time there may be a sure pattern
to this mornings COMS behavior. My bet is that there
will be a point to dump all stocks before Uncle Al
gives us the result at 2:00pm(? I think). Good buying
opportunity.

I'm looking for below 35. If I don't see it, that
means options are going to push it up to 36, IMO.

Just my guess of the day.

Still pretty good volume though, but down 1/4.
