BMFM, IRS will nail you for that. My accountant told me that it is not legal any more. As soon as you make an opposing trade, either sold it or sold short, considering that you captured the profit/loss and closed the transaction. I shorted and long YHOO last year for this purpose but it didn't work out. Check with your accountant to be sure though.

PS: but I think you still can do it with option.
