To the Comdex attendees: do you see any new products of any form featuring "high performance batteries?" Of course it would be nice to know that such batteries were Valence's, but of equal interest is knowing that there are such batteries beginning to appear. They would be somebody's product, and that is intrinsically important to us, no matter who's.

About the patent matter: The Valence patent portfolio caught my attention several years ago, and has helped support my morale through the lean times right up to now. However, as I am not an expert in the chemistry or manufacture of batteries, I know I have no capacity whatsoever to judge them individually.

Consequently, I think the way they should be viewed is, if you will, as mines in a minefield which competitors may or may not have to cross, and which may or may not trigger if they do have to cross it. I take comfort in their numbers. We do not, and really cannot know which will prove valuable, if any at all. That can be gauged by those few with relevant skills, but their value ultimately is revealed only through licensing agreements or litigation. But meanwhile, they constitute a problem for competition by raising the FUD factor and the associated costs. The competition has to incur the expense of finding a way around the minefield, or incur the expense of tiptoeing carefully around each possible mine.

In this spirit, I welcome Zeev's efforts at gauging their value, but no matter how well founded his conclusions, they remain only opinions until confirmed or overridden by licenses or court rulings. For now, their value lies in their uncertain impact.
