It is safe to say that we all agree -- the use of photographs to make this decision was highly suspect. It serves as yet another reminder of rule #1 for biotech investors: the FDA has the blatant power to be just as capricious and illogical as it wishes to be.

However, with the positive recommendation rendered, Panretin is almost certainly looking at an approval. Once that happens, no one will care what the advisory committee had to say. And so, the issue of the use of the photographs is largely moot, in my opinion.

I really liked Peter's "goalpost/photographic replay" analogy, though.
