A buy stop will occur whenever the ask reaches the stop price. It is not necessary for any trade to occur before the stop is triggered.
Also, in a fast moving market it is very possible to be executed above your stop. I've been executed at 42 for a 40 buy stop on a hot internet stock.
Also be warned that in low volume stocks asks have a mysterious way of rising up just high enough to trigger the stop and then falling back down. Not that the MM's would do that deliberately of course <g>.
