Gates May Change Tactics And Testify In Case

WASHINGTON -- Microsoft CEO Bill Gates may end
up testifying in the government's antitrust suit as part of
his company's revised legal strategy, said the lead Justice
Department attorney on Thursday.

"[Gates] is indicating more and more that he'd like to
come to testify. I'm sure his lawyers will listen to him,"
said government attorney David Boies, outside the
courthouse. Boies cited comments by Gates at
Microsoft's recent annual meeting and other interviews.

Gates may sense the case is not going as well as
planned, Boies said. "If the present game plan is not
working, it wouldn't be uncommon to change the
strategy," the attorney said. "It is not unusual in litigation
and sports to change the strategy."

If Microsoft calls Gates, the government will be able to
question him under cross-examination.

Gates was not included in the original list of 24 witnesses,
12 each for the government and Microsoft. But U.S.
District Judge Thomas Penfield Jackson held out the
option for each to call two surprise witnesses. So far,
Gates has appeared in the courtroom only through his
taped deposition and e-mail.

The last time Gates testified in person in Washington was
in March, when he appeared before a Senate committee
investigating competition in the software industry. At that
time, Gates and U.S. Senate Judiciary Chairman Sen.
Orrin Hatch (R-Utah) engaged in a testy
question-answer session.

The trial is completing its fifth week. Court will be in
session for just two days next week before the
Thanksgiving holiday.

OK, Amazon.com 164 up $15 1/2 or 10.44% today, it doesn't compete with Netscape's performance today, up 34.19%, but it will have to do and up about 35 points since our recommendation two days ago...sooooooooooo boring! If you sell it, you're in for it...we are not after cheesy two or three points...ARE WE?

Our favorite stock to get all you people back your money your threw away with bucket shops over the past five years, AMBI [2] has now more than doubled since first recommended about 45 days ago. SLR... $62 1/2 after a blast to 68...accumulate the low volume and any break of $60

America on Line [AOL-83 1/4] up 7 7/8 today and split of course 2:1 is up so much since VTAR (c) recommended it, it's sickening, isn't it?

Novell [NOVL-16 5/16] up about 8.3% today and up about 50% since recommended here to take care of a trading loss in two gold stocks [HM & NEM] that I was stupid enuf to recommended for a trade. We have made that minor loss up and then some. But here is an important point. Losers surely should not be the rule...if they are, throw darts...but on the occasion that they develop, get onto a horse that is working and that horse, for us, was and remains Novell. Hold.

But the stock of which I am proudest is Micron Electronics [MUEI-22 1/4] + 9/16 today and worked PERFECTLY...I mean if it was any more perfect, I would have to turn myself into the SEC and have myself investigated.... first, we buy the stock around $16...it moves to almost $25...we recommend trading profits and a re-entry point AFTER TAKING those profits of $20 1/2...and guess what? The reaction low looks like $20 3/8! I mean let's go to the videotape...see chart above. MUEI is our choice in PC's, not Dell, not GTW not CPQ.
