Ed,

The DOJ is not lawyers representing NSCP! The DOJ has an independent case against MSFT to determine if MSFT has violated anti-trust laws. The anti-trust laws that they broke are based around past (and current) activities by MSFT.

Since the DOJ is not in court to simply represent NSCP, then NSCP's merger with AOL is not an issue. You and Paul have forgotten the exact reason why the DOJ is in court. regardless if NSCP has a new owner, the law was still broken.
