He made a statement before he went into Court today to the press saying exactly what I expected him to say. MSFT is currently rocketing to the upside!!!

For those who do not understand the subtleties of the anti-trust case.
I assume the Court will find MSFT is a monopoly and that MSFT engaged in anti-trust type activities with regard to its contracts and actions.

But that isn't the essence of the case. The essence is remedies! What does the Justice Dept. ask for as a remedy? Since they did not bring this case on the basis of MSFT using its monopoly power over the OS to prevent competition of other companies applications with MSFT's but instead focused narrowly on the NSCP browser, then its too late in this case to change the nature of the case. All the time constraints placed upon preparation and the focus of the case will not allow this case to result in a breakup of MSFT. THe most they can ask for is a fine and a change of business practices. Anything else and the case is going to be overturned on Appeal. You can't take a narrow case and broaden it especially when your principal complaint concerns a company that solved its competitive problems with MSFT by merging into a more formidable MSFT competitor.
