John,
Thanks for your reply to zurdo regarding IBM's price history. You are completely on target.

Regarding <<1) Is anyone concerned about the total likelihood of extremely "hot" merchandise being sold over EBAY, and if EBAY has any liability regarding that?>>

I am not long this stock for a few reasons. One of which is this issue. Sooner or later, lawyers are going to file suits because a buyer or seller got ripped off, a 12 year old bought an escort, somebody sold Cuban cigars, who knows... If I were the company, I would have my lawyers immediately draft some protectionist policies to inform both buyers and sellers that you're swimming at your own risk. Or, be awful vigilant about patrolling the inventory...

That said, I am not a user, and there may be disclaimers in existence already. But even if there are there are enough creative lawyers in the country to sneak in a backdoor somewhere.

You don't need to wait till 2030 to check my investment...I bought 4000 shares of EBAY late last week for 143...Sold today for 193...That's a cool $200,000 profit in a couple of days...minus a few bucks for commission fees. Of course I am not as smart and informed as you are, so I take these foolish chances...Since I am not in law enforcement or internet policing, I have no idea what EBAY sells, and I couldn't care less...Happy trading!!!

Hello John:

Will give a stab at both questions, although I am sure there are others with more/better info....

<1) Is anyone concerned about the total likelihood of extremely "hot" merchandise being
sold over EBAY, and if EBAY has any liability regarding that?>

My understanding is that ebay is saying that it is not physically practical to monitor all of the thousands of items for auction on an ongoing basis. This makes perfect sense to me. Should the FTC (or whatever fed agency oversees such matters) decide otherwise, that would certainly be a huge issue....

2) What is EBAY doing to gain new buyers and sellers?

Don't know any particulars, but must say that their ipo and the incredible stock appreciation since then has certainly catapulted them into the media's starlight. That "brand recognition" must certainly be translating itself into more traffic, at least short term....
