MSFT is going to ask Justice to throw out their case now that AOL is buying Netscape, citing that this demonstrates that it (MSFT) does not have a monopoly:

Although I hope MSFT does not get their own way, I do have the gut feeling that MSFT officers were jumping for joy when the AOL announcement was made since now, Netscape will cease to exist on its own according to the article you pointed us to [thanks, Judd]:
