<dismissed the purported class action claim> At first glance, I would not apply this news to anything substantive about the grievances, complaints and other class action suits against Shiva and the Bd.

It would appear that there weren't sufficient members in the "purported class" ----- most likely because of the larger class action suit(s) that have already established their class(es).

My advice to all of you ---- keep at it, do not relent.

Wishing all of you a wonderfully fulfilling holiday.

After turkey and the Cowboys, I will be heading to caddy class ---->advanced training for my new assignment. :)

Bob,

The Class Action Lawsuit being dismissed was initiated long before the Company was put up for sale to Intel. In fact it had nothing to do with the current "sale" complaint!!!!!! They are just trying to blow a smoke screen!

Could someone please clarify this: The Lirette case was said to be dismissed: "Lirette v. Shiva Corporation Class Action Claim Dismissed
BEDFORD, Mass., Nov. 24 /PRNewswire/ -- Shiva Corporation (Nasdaq: SHVA) announced today that on November 19, 1998, Judge William G. Young of the United States District Court for the District of Massachusetts dismissed the purported class action claim filed against the Company, Frank Ingari, Cynthia Deysher and David Cole on May 21, 1997 (Lirette, et al. v. Shiva Corporation, et al.)."

Now it says Shiva is settling:"The cases involved are Schwartz, et al. v. Shiva Corporation, Los Angeles Superior Court Case Number BC 164278 and In re Shiva Corporation Securities Litigation, United States District Court for the District of Massachusetts Civil Action Number 97-11159-WGY. The settlement amount is $4.35 million, a portion of which will be paid by Shiva's insurer."

The Lirette case IS:"Lirette, et al. v. Shiva Corp., et al.
U.S.D.C. D. Massachusetts
Case No. 97-11159WGY [5/21/97]"

What gives? I am a sucker...er...former Shiva stockholder during this period, and would greatly appreciate any insight here.
