On Nov. 27, Madame Justice Baker, of the Supreme Court of British Columbia,
in an oral decision, dismissed Atna's application for a declaration that
its right of first refusal contained in the joint venture agreement with
Boliden Westmin had been triggered and exercised by the intended sale by
Boliden of its 60 per cent interest in the Wolverine project to Expatriate
Resources. The effect is that Atna will not be entitled to increase its
interest in the Wolverine project from 40 per cent to 100 per cent. The
main asset is the Wolverine deposit (6.2 million tonnes of 1.3 per cent
copper, 1.6 per cent lead, 13.7 per cent zinc, 370.9 g/t silver and 1.8 g/t
gold) in the Yukon Territory.
