Gary, I day trade a variety of stocks, including DELL, INTC and others. Could I avoid the wash sale rule for DELL if I were just flat DELL for 31 days, while still trading INTC?

Yes that would do it. At the end of 31 days of being flat DELL you would not have any outstanding wash-sales in DELL, therefore all your losses in DELL would be fully reported on your tax return, Sch D.
