Andy, I'm afraid you're a lonely warrior on the copyright front. I agree with you on the arbitrary and capricious nature of law, to some extent. To repeat as usual, Microsoft seems intent on moving beyond copyright into straight contracts and licensing, reinforced with the lovely UCC article 2B "reforms". The world of contracts is even more arbitrary, especially when you get to lobby for your own laws enforcing newfangled constructions like the shrink-wrap license. My personal view is what I understand to be, approximately, "critical legal studies"- the law reflects the power structure of society.

Like I said on today's NYT article, I'm as cynical as the next guy. Open software beats cheap copies of binary code anyway- something for all to build on. Shoulders of giants and all that.
