From what I have seen, most shorting of BB stocks takes place in Canada and the Caribbean. It is possible for individuals to open a foreign account and short them from the United States. Also, domestic MMs can and do short BBs by selling shares they don't have. For WINR, I think the majority of shorts covered on the last big run-up and then jumped back in to drive it down. This time around, the majority will likely cover and stay that way once WINR becomes operational. Too much volatility could scare them.
