Massachusetts court rules against Cablevision December 9, 1998 10:40 AM BOSTON, Dec 9 (Reuters) - Cablevision Systems Corp CVA lost a battle in its war with Boston Edison's cable television venture when Massachusetts's highest state court ruled against one of the nation's leading telecommunications companies, the Boston Herald reported on Wednesday. Woodbury, N.Y.-based Cablevision, with 3.3 million customers in eight states, is trying to block Boston Edison's entry into the cable, telephone and Internet markets. Earlier this year, Boston Edison's holding company, BEC Energy, formed a partnership with New Jersey-based RCN Corp RCNC to deliver those services over the utility's fiber-optic lines. Cablevision alleges the system was paid for by electric customers and would be an improper transfer of assets from a state regulated operation to a new marketplace cable TV venture. The Massachusetts Department of Telecommunications and Energy (DTE) is still investigating the BEC-RCN agreement. This court case began when Boston Edison sought permission from the state agency to set up BEC Energy, the newspaper said. Cablevision sued seeking intervenor status, which would have given the cable company more say in the proceedings. DTE denied Cablevision's bid and the company sued. The court agreed with the state agency in a ruling on Tuesday. Earlier this week BEC Energy announced an agreement to buy agreement with Commonwealth Energy System, CES the parent company of Cambridge, Mass.-based Commonwealth Electric for $950 million.
