I don't believe the part about not being able to sell it electronically. If I sell this via E-Trade or any other legitimate broker, electronic or otherwise, and have a statement proving the sale, I am sure it is perfectly valid. And the $3000 loss is not really correct...it's $3000 maximum after offseting all your gains. So if you had a capital gain of $10,000 on 3 stocks, and lost only on MTEI $5000, yes, you claim $3000 for a loss and use $2000 next year. FOr example, if you had a $5000 gain, then you could claim the entire $5000 MTEI loss as an offset.
