As a matter of fact, the rules were clarified recently.

Positions are supposed to be netted in deciding whether the uptick rule is required.

And the net is against all accounts that you have control over. (Even Uncle Bob's account if you are authorized to trade in it for him!!)

Another useful method of tweaking the rules eliminated. (Short at broker 1, long at broker 2 would make it impossible for your broker to police you, but would still be "against the rules")
