It's a sorry state that we're in here at Datek. Stories like yours hardly raise an eyebrow anymore, they're so common. In the old days, I'd demand a fill in this case, but I never had to. I would have been filled in the first place. With listed stocks it's fairly easy to get the broker (even Datek) to get you the fill you deserve. With Nasdaq they don't even bother trying.
