Not only did the appeals court overrule the judge, they issued a "writ of Mandamus" against him for his procedural violations. Most judges do not have such a sanction levied against them in their whole career. Basically, they came as close as they could to calling him incompetent.

This is why I feel he will rule against MSFt only if DOJ has a strong case. Why would he want to look incompetent, again. The judge has made it into future history books and I am convinced that he would not want to be portrayed as incompetent. You got to remember when he first issued his rulings against MSFT, he did know how the Appeals court would view his judgement. NOW HE KNOWS. I still thinks he just wants to make Softee look bad and that is all. He may just rule against them in minor areas -- example- contracts with ISPs.
