I believe that marketmakers are allowed to short a stock at any time, at whatever price, as they need to keep their sheets balanced. I think that also includes naked shorting, which is why the tell-tale sign of a stock in deep $hit is when you get threaders advising everyone else to "call in for their certificates." I would imagine that marketmakers control much of the general float of a stock like ELGT's at a time like this, and they would be as prone to a short-squeeze as you or me.
