WTO Expected to Make Ruling in Favor of Korean Chipmakers Toward Dec. 24 Deadline

The World Trade Organization is expected to rule that the United States does not have a right to refuse to take Korean chipmakers off its list of companies facing anti-dumping investigations.

The Ministry of Commerce, Industry and Energy said yesterday that a panel under the dispute-settlement body of the WTO concluded that Washington's refusal is not in line with international trade practices.

Regulations of the Department of Commerce state that foreign companies must be taken off the investigative list if ''it is not likely that those persons will in the future sell the merchandise at less than foreign market value.''

Korea filed for bilateral consultation with the WTO after the United States refused to exclude Hyundai Electronics Industries and LG Semicon from its anti-dumping rules despite the fact that the two companies were slapped with anti-dumping duties of less than 0.5 percent for three years running.

The petition was filed with the WTO on Aug. 13 last year and a series of bilateral consultations failed to produce a compromise, thus pushing Korea to ask for the formation of a three-man panel under the dispute settlement board.

While the ruling will not have an immediate effect on exports of Korean semiconductors to the United States, it has important implications since a number of other Korean items are facing anti-dumping investigations.
