" Evidently the matter has been turned over to the SEC/NASDAQ for review. We shall find out shortly if Mr. Cramer crossed the line."

i hope they give him the "roger miller" treatment. which, if you remember the song Dang Me, involves hanging from the highest tree.

I don't watch television, and I can't find a transcript on the net. So I have to go by what WavePhore said, and try to filter out company bias.

WavePhore had three specific allegations. Taking them in reverse order:

"Greenspan doesn't like WavePhore going up." As I read it, this is shorthand for "Greenspan doesn't like irrational exuberance, such as many Internet stocks are now demonstrating in spades, and WAVO is one of those stocks." No problem.

He tried to short some. Ok, he tried to short some. That's his job. And he disclosed his (attempted) trading activity, which is the right thing to do.

I do question CNBC's editorial judgment in giving him the position of guest host. Someone with an interest in an issue should be a subject in a news report, not a host. Again, no problem, except for the day traders who are crying now because their hype machine broke down.

"Fraud-U-Net". Oh, my God. That's a big problem. Mania-Net, sure. Tulip.com, fine. There is a ton of facts and logic to support that characterization. But fraud! Where is the evidence? Where are the cooked numbers; where are the documented lies? Fraud is the most serious accusation there is in this business.

I haven't seen the original interview, and I haven't seen the followup CNBC interview, which I presume had a retraction. I don't know what the context of that word was. But I would suggest Mr. Cramer refrain from using the word "fraud" on national television to describe a company, unless he's talking about actual fraud, like Cendant.
