I don't know what evidence Smaltz introduced in specific and therefore could not comment on what he might have missed. As for the make up of the DC Appeals panel, I don't do a lot of appellate work and none in DC. I'm not sure of the current members of the panel nor their identities. However, seeing that Espy got the boot from the ethically challenged WH, the other defendants pled out and Espy admitted to taking the gifts and good things did follow meetings with Espy, I can't imagine a logical basis for an acquittal. JMHO. JLA
