When the SEC filed to overturn the bankruptcy judge restraining order on giving trade secrets to competitors they had to substantiate claims made against the company. One of the more peculiar aspects of that (if memory serves me right) was the timing of the Wall Street Journal and Baron's articles. Could be wrong but believe the SEC said the articles initiated its investigation but the articles said that SEC had already begun an investigation. Might be wrong but the timing was very peculiar. Discovery is going to be very interesting.
