Ericson knows it can prevent Qualcomm's proposal from being incorporated simply by claiming they have IPR. They know they dont have to prove anything to the ITU. That is why the court date in Texas to clear up the IPR issue is scheduled for after the ITU is due to publish their recommendations.

I agree with you, however Ericsson has stated that [it] holds that it has patents and/or pending application(s) for patent that are essential to the two different proposed 3G standards based on W-CDMA and cdma2000

In the US, unlike other countries, applications pending at the United States Patent and Trademark Office are not published. These applications are considered secret and will only be published upon approval, i.e. patent.

Therefore, although one could evaluate Ericsson's current IP portofolio, one does not know the number or subject matter of Ericsson's current pending applications.
