I believe ABX just put out a news release where they disclosed that they have 9.9% of ARP's shares already... if they reach 10% I think they would need to put out another news release say so?

Also, ABX needs 51% of the shareholders of ARP to turn over their shares to be successful with their $4 offer (the ABX news release stated that they were going to try to buy ARP out at $4). I have always wondered if if company such as ABX would go so far as to get "friends" to buy shares in the open market either before or after they make their takeover attempt? ... that way they know they have these "friends" who will turn over all of the shares they have accumulated. If they were to get 5 "friends" to each acquire 5% of the companies shares.... they would get 25% right from the start...

.... just a thought... I'm not saying that they do anything like this... I'm just pointing out that if I can think of it, what's to stop a company like ABX from doing something like this? It would allow them to lowball a bid and get the company cheaper than it normally could have.

I still think the bid will have to go up from $4 though... I find it hard to believe that ABX actually thinks that they would stand a chance of getting 51% of the shares tendered for a $4 offer..... $6 will likely be the minimu... (I just wish I owned some shares...)
