Of course they could go private. From investment standpoint, it makes perfect sense for the management to take it private. Since they would most likely be buying in the open market, I doubt there would be a tremendous amount of merit to any lawsuits.

However, does this make sense from a growth standpoint? Well, if they secured enough financing from the recent offerings, then yes. But, I doubt that is the case if they really intend to push the envelope in R&D. They need access to capital and most of that access would dry up if they went private. Sure, they could still do debt deals.

I doubt it's going to happen, but that's just my opinion. They're stuck with the mess and they need to straighten it up.
