The appeals court provided a test for illegality and stated that the information which came out during the contempt-of-court hearing was not sufficient to meet that test.

For the record, I happen to think that ordinarily, Microsoft gets the benefit of the doubt as far as internal technical details. Nobody knows the internals of Windows better than Microsoft. However--the problem for Microsoft is, in my view, that they are going to be viewed pretty much as a bunch of liars, so why believe them when they say they had to do it? Once again, Bill Gates' deposition saves the day for the DOJ.
